The TV broadcasting industry<\/a> is divided on implementing New Tariff Order<\/a> (NTO<\/a>) 3.0 from February 1. Many distribution platform operators (DPOs) have failed to file the fresh Distribution Retail Price (DRP) while some have already come out with new packages for consumers.

NTO<\/a> 3.0 implementation might not get fully implemented due to division in the TV distribution industry<\/a>. The All India Digital Cable Federation (AIDCF) has mounted a legal challenge against the NTO 3.0 implementation and many of its members have not yet filed the DRP.

Multiple industry leaders said that the DPOs are awaiting clarity from
Kerala High Court<\/a> which will hear AIDCF's plea against broadcast tariff amendments on 8th February.

As per the timelines laid down by the sector regulator
Telecom Regulatory Authority of India<\/a> (TRAI), the tariff amendments, which are popularly called NTO 3.0, were expected to come into effect from 1st February.

DPOs had to file fresh DRP of pay channels and bouquets by 1st January. Irked by the lack of compliance by the DPOs, the TRAI has issued a letter to DPOs seeking compliance reports from them.

\"All such DPOs, who have not declared tariff as per the provisions of Tariff Amendment Order, are directed to comply with the provisions of the Tariff Amendment Order and report compliance to the Authority immediately,\" the TRAI said in its letter dated 19th January to DPOs. Industry sources say that most DPOs have not yet inked interconnection agreements with broadcasters based on NTO 3.0.

\"The NTO 3.0 is unlikely to get implemented on the ground since the matter is sub-judice. The Kerala HC has not given a stay, but it will hear the matter on February 8. The industry is in a wait-and-watch mode,\" said the CEO of a leading cable TV company.

\"Most DPOs are not prepared to implement the NTO 3.0 since it involves a lot of changes at the backend due to new pricing and taking consumer choice is a time-consuming process,\" said the CEO.

A TRAI official, however, said that many cable and direct-to-home (DTH) service providers have submitted their fresh pricing while the ones who have not complied have been asked to send a compliance report.

Elara Capital SVP Karan Taurani said that the NTO 3.0 will eventually get implemented even if there is a slight delay. \"The DPOs fear that they might lose customers if the price hike gets implemented, but the NTO 3.0 will come into force even if the implementation gets delayed,\" he added.

In the previous hearing on January 6, the Kerala HC had refused to grant a stay on the NTO 3.0 while adjourning the matter. The promoter of a leading cable TV company said implementing NTO 3.0 will sound the death knell for cable and DTH companies which are already reeling under subscriber loss due to competition from over-the-top (OTT) and DD Free Dish, the free DTH platform from
Prasar Bharati<\/a>.

\"Cable and DTH companies have been losing customers for the last three years. Implementing NTO 3.0 will lead to an acceleration in consumer churn,\" said another CEO of a cable TV company.

In November 2022, the TRAI amended the NTO 2.0 by going back to the MRP cap of Rs 19 besides doing away with twin conditions that linked bouquet pricing to individual channel MRPs.
