Mumbai: Sewa Shram Shakti Foundation<\/a>, a non governmental organisation, has moved the Supreme Court, filing an intervention application seeking swift recovery of statutory dues from telecom operators<\/a>. The NGO<\/a> petitioned that delays in recovering adjusted gross revenues (AGR<\/a>) will cause loss to exchequer, violating fundamental rights of Indian citizens.

The petition comes on the back of
Vodafone Idea<\/a> (Vi), Bharti Airtel<\/a> and Tata Teleservices (TTSL) moving apex court earlier this year, pointing out errors in calculations of AGR dues<\/a>.

NGO<\/a> had earlier moved SC opposing Vodafone Idea<\/a>'s (Vi) plea to clarify \"errors\" in adjusted gross revenue (AGR<\/a>) dues. The foundation had then called Vi's plea \"baseless\", \"frivolous\" attempts to overturn the earlier orders of the apex court and there was sufficient time given to the telco to correct any discrepancies in the calculations.

Vi has appealed to the top court to allow the government to consider the telco’s submissions on the calculation errors and rectify them accordingly. Vi has to pay Rs 58,400 crore in
AGR dues<\/a>, of which it has paid Rs 7,854 crore. The telco had self-assessed its dues at Rs 21,533 crore, which the top court had earlier rejected.

Airtel<\/a> has sought for a modification, clarification or recall of “mistaken orders” that allowed the government to demand Rs 43,980 crore as AGR dues against the telco’s calculation of Rs 13,004 crore. TTSL , which has AGR dues of Rs 16,798 crore and has paid Rs 4,197 crore has moved SC on similar grounds.
