The Department of Telecommunications (DoT) has informed the Supreme Court that the AGR payments made by telcos can't be said to be full and final and that the government will await the court order to calculate final AGR liability on traded/shared spectrum.

In an affidavit filed before the hearing on Monday, the
DoT further said that adjusted gross revenue (AGR) is based on entire revenue generated by a telco and is not dependent only on revenue from spectrum.

The government's latest affidavit will not bode well for Reliance Jio and
Bharti Airtel who have insisted that they can not be forced to take on the AGR liabilities of bankrupt telcos they had shared and/or traded spectrum with..

It has added that spectrum trade by telcos under insolvency took place in 2016-17
Reliance Communications (RCom) has shared and traded some of its spectrum with Reliance Jio Infocomm. Aircel and Videocon have traded spectrum with Bharti Airtel.

AGR dues have been paid to the tune of Rs 195 crore and any shortfall will also be paid to the extent of use of RCom’s spectrum, Jio has said earlier. Airtel, said that he would have to review all the older arrangements to get at the AGR dues of Aircel and Videocon sought to be passed on to Airtel. DoT has sought Rs12,389 crore from Aircel, and Rs1,376 crore from Videocon.

The AGR war between the government and telcos has many battlefronts . DoT is in a tussle over ownership of spectrum and has opposed the resolution plan of Aircel and RCom in various courts. At the same time its latest affidavit means Airtel and Jio may have to pick up additional spectrum dues than what they have paid for so far.

The court is also expected to give its final judgement on the timeframe needed to pay AGR dues , a verdict on which Vodafone Idea's future hinges.
