New Delhi: Xiaomi India<\/a> has moved the Karnataka High Court<\/a> to challenge a second attachment order by the income-tax department, seeking to seize Rs 3,700 crore fixed deposits of the Chinese smartphone company<\/a> for alleged tax evasion<\/a>.

The
I-T department<\/a> had passed a second attachment order on December 29, 2022, under similar grounds as the previous one, alleging that Xiaomi<\/a> continues to remit money abroad under the guise of royalty, resulting in tax evasion.

In its petition, the company has argued that the latest order is similar to the previous attachment order passed by the department in August 2022, which was later quashed by the High Court citing it to be void of the doctrine of proportionality.

The court has asked the matter to be placed before the division bench which is seized of the previous writ petition filed by the company challenging the earlier attachment order.

“We would like to reiterate that our operations in India are compliant with all local laws and regulations and we will continue to be compliant at all times,” a Xiaomi India spokesperson told ET.

After hearing both the sides, Justice B M Shyam Prasad observed that there could be certain overlaps in the two orders despite having distinct grounds. “Therefore, this court is of the considered view that for complete and effective adjudication without protraction, this writ petition may have to be placed before the division bench which is seized of the aforesaid writ petition,” the judge said in an order passed on April 19, 2023.

The matter will be listed at the earliest subject to the orders of the chief justice of the Karnataka High Court, the court had said.

The matter is running in parallel to the Enforcement Directorate’s seizure order against Xiaomi, seizing over Rs 5,500 crore from its bank accounts. While the company challenged the order before the High Court, the court ruled in favour of the ED and asked Xiaomi to take the matter up with the appellate tribunal under the Foreign Exchange Management Act (FEMA).

Meanwhile, the income-tax department has filed an appeal challenging the dismissal of the previous attachment order by the court.

Amidst the legal challenges, Xiaomi India’s share in the Indian handset market has been steadily declining. In a recent report, Counterpoint Research noted that the erstwhile market leader slipped to the third position, suffering a 44% on-year decline in shipments.
