<\/span><\/figcaption><\/figure>Mumbai: The Delhi High Court<\/a> issued a notice to the State Bank of India (SBI<\/a>) and others to seek their response on whether Chinese lenders should be impleaded in a case filed by Anil Ambani<\/a>, where he is challenging the bankruptcy court’s ruling to appoint an interim resolution professional (IRP) in the personal guarantee case.

Along with SBI, Insolvency & Bankruptcy Board of India (IBBI) and the Ministry of Corporate Affairs will also have to file their responses in a plea filed by Ambani, where he is seeking to implead the three Chinese lenders - Industrial and Commercial Bank of China, Export-Import Bank of China, and
China Development Bank<\/a> - in the case.

The court will hear the matter further on November 10.

On August 21, the National Company Law Tribunal (
NCLT<\/a>) decided to appoint Jitender Kothari as IRP to assess Ambani’s assets and liabilities and take a call on the petition filed by SBI. The state-run bank had moved NCLT to recover over Rs 1,200 crore from Ambani under the personal guarantee clause of the bankruptcy law. The lender said Ambani had personally guaranteed loans taken by Reliance Communications<\/a>, currently undergoing insolvency proceedings, which the state-owned lender is trying to recover. Ambani is challenging the appointment of the IRP.

“SBI had based its application to continue the moratorium on the basis that the three state-owned Chinese Banks may attempt to enforce a UK Court order. The Division Bench issued a notice on the application for impleadment of the three state-owned Chinese Banks (i.e. ICBC, CDB, C-Exim) in the proceedings before the Hon’ble Delhi High Court,” said a spokesperson for Anil Ambani.

On May 22, a UK court ordered Ambani to pay $717 million to the three Chinese banks within 21 days, after ruling that a personal guarantee which the Indian businessman had disputed, was binding. No payment has since been made. Recently, the three Chinese banks have said that they will pursue all legal routes to protect their rights and recover their due amount from Ambani.

“The matter in the UK Court of the state-owned Chinese Banks pertains to an alleged personal guarantee for a corporate loan availed by Reliance Communications Limited in 2012, 8 years ago, from three state-owned Chinese banks, and not a personal loan of Mr Ambani,” said the spokesperson. “Mr Ambani will continue to take all steps as he may be legally advised to defend himself to the best of his ability in any further proceedings that may be brought in this matter.”

Additional Solicitor General (ASG) Madhavi Diwan is representing IBBI and the Ministry of Corporate Affairs in the case, while Anil Ambani is being represented by Senior Counsels Harish Salve and JJ Bhatt. SBI is being represented by Senior Counsel Neeraj Kishan Kaul along with Nirav Shah and Ryan Dsouza of DSK Legal.

RCom<\/a>, gone under a debt of Rs 46,000 crore, is awaiting the insolvency court's approval on the resolution plan in which its assets are expected to be sold to UVARCL<\/a> and Reliance Jio<\/a>.
