Bombay high court to pass judgement on new tariff order on August 24.

The Bombay High Court on Wednesday said it will issue the final order in two weeks, in the matter related to the new tariff order amendments for the broadcast sector by the Telecom Regulatory Authority of India (Trai).

While hearing the petitions via video conferencing, Justice AA Sayed said that there is no need to hear the matter again as the final order will be announced in two weeks.

The original division bench of Justice AA Sayed and Justice Anuja Prabhudessai, which had reserved its order on March 4th, also barred Trai from taking any coercive action against the TV broadcasters for not complying with the new regulations of the tariff order (
NTO 2.0) till it issues the order on August 24th.

Trai had, on January 1st, notified amendments to the tariff order of 2017, which were challenged in the Bombay high court by the broadcasters.

The parties to challenge Trai were Star & Disney India, Zee Entertainment Enterprises (ZEE), Sony Pictures Network India (SPN) and TV18, along with
the Indian Broadcasting Foundation (IBF) and the Film and TV Producers Guild of India.

After hearing the arguments from all the parties, the court had reserved its judgement in March, before the Covid-19 pandemic resulted in a lockdown.

And while the court had not given any interim relief in the matter, on July 24th, Trai asked the broadcasters to comply with NTO 2.0 and publish the revised rates of their respective channels and bouquets by August 10th.

The broadcasters once again moved to the court, seeking relief as NTO 2.0 severely impacts the channel pricing ability.

Under the new regulation, Trai has reduced the cap on the MRP of individual channels, which were part of any bouquet, to Rs 12 per month (from earlier Rs 19) and has also imposed twin conditions for the bouquet formation, which restricts the discount on channel bouquets to around 33%.
