<\/span><\/figcaption><\/figure>Airtel Kenya<\/a>, the Kenyan arm of Airtel Africa<\/a>, and the Communications Authority<\/a> of Kenya<\/a>, have reached an out-of-court settlement on a seven-year old legal dispute around an expired permit relating to a transaction with the Essar group.

Under the settlement pact terms,
Airtel<\/a> Kenya will pay $17.5 million to the Kenyan telecoms regulator for its licence renewal. The payment will happen over the next two years.

“We’ve had this long-standing dispute with Airtel over the Essar transaction..the dispute has been there for seven years but I am glad we struck a deal, and this is a major achievement for us,” Ezra Chiloba, Director General, Communications Authority of Kenya, reportedly told an African business daily.

Airtel Kenya's licence had reportedly expired in February 2015.

At press time, Airtel Africa declined to offer comment to ET’s queries.

Back in 2014, Airtel Kenya had reportedly paid $6.97 million to acquire yuMobile from
Essar Telecom<\/a>, Kenya. Airtel Kenya had then claimed that at the time of acquiring the yuMobile assets, the Kenyan telecom regulator had agreed to merge its operating licence with yuMobile. But once the deal was finalised, the regulator insisted that Airtel must pay $17.5 million to renew its permit.

Communications Authority of Kenya, on its part, had said that since the yuMobile permit was not automatically transferred upon acquisition by Airtel Kenya, the latter must pay the additional sum to renew the licence.

Airtel Kenya, a wholly-owned unit of Airtel Africa, is reportedly seeking an exemption from a rule that requires local shareholders to own at least 30% in telecom companies by March 2024. The Kenyan government, however, had insisted that Airtel Kenya must renew its licence first before seeking any waiver of the local ownership rule.
