<\/span><\/figcaption><\/figure>It was late Wednesday evening. The telecom department (DoT) released a draft telecommunications bill, seeking views on a series of policy<\/a> matters with an aim to bring in a few radical reforms to ease the prevailing regulatory environment.

In line with long-standing industry's demand, minister of communications
Ashwini Vaishnaw<\/a>, an ardent advocate to bring vigour to the beleaguered sector, sought to do-away with legacy provisions<\/a>.

The proposed framework aims to consolidate the telecom sector's governing framework that includes
Indian Telegraph Act<\/a> 1885, Indian Wireless Telegraphy Act 1933, and The Telegraph Wires, and (Unlawful Protection) Act 1950.

The new law in works, seeks to settle some of the contentious matters through a consultative approach while the protection of subscribers or users, has taken a centre stage in the new draft bill that proposes a light-touch regulation as well as accountability.

In addition, the draft law sought to minimise regulations, discourage uncertainty, and a federal structure backing for right-of-way that continues to be an impediment to telecom infrastructure deployment and expansion.

The Centre also lays an emphasis on some of the pertinent issues such as spectrum management and over-the-top (OTT) applications by bringing them into the ambit of the law.

The department invoked the sacred text<\/a>, “In a way, spectrum is similar to atma<\/em>, which is ajar<\/em>, amar <\/em>as described in Shrimad Bhagwad Gita<\/em>. Like atma<\/em>, the spectrum too does not have any physical form, yet it is omnipresent.\"

In the Mahabharata battlefield, when Arjuna put down his weapons, Lord Krishna convinced him by reciting Gita's verses that says atma <\/em>(soul) is everlasting and can’t be destroyed by anyone.

This, however, indicates significance of spectrum and its assignment, and as we know, it is an infinite natural resource.

But, the natural resource as also emphasised by the
Supreme Court<\/a> in its 2012 landmark verdict, to go under the hammer, is a logical and rational step.

The department headed by Vaishnaw, has provided a legal backing to the spectrum sale including the frequencies for space broadband services except for select public sector purposes.

The move has brought in clarity, and put speculations to rest and the Centre backed same-service-same-rules dogma, to avoid further litigations,

On the other side, the over-the-top (OTT) players such as WhatsApp, Facebook and Google, have come under the fold of telecommunication services with a light-touch regulatory regime. Telecom service providers have been seeking a level-playing field as they argue that mobile apps not only erode their business but enjoy a free ride on their networks.

In order to facilitate ease of doing business and attract investments in the sector, the department proposed a change in terms and conditions of the licensing framework. For a company to set up a shop, either a license, registration or an authorisation would now be required instead of cumbersome and time-taking legacy processes.

Corporate developments such as restructuring and insolvency have also been taken into consideration. While, it encourages due obligations to be followed, merger and acquisition (M&A) is proposed to be a simple process where only intimation is needed rather than a permission.

Last but not least, a streamlined know your customer (KYC) regime<\/a>, is in the works that encourages 100% adherence including Voice over Internet Protocol (VoIP) calls to effectively curtail privacy violations.

The Centre seeks stakeholders and consumer groups to review and put forth their views on the proposed law before the draft finally comes under the Parliament's scrutiny by early next year.
